Terms of Service
1. The service
Varianton is a Shopify app that lets merchants add a live product customizer to their store — configurable options, colors, custom text and uploaded logos — and charges the configured price at checkout. We may improve, change, or add features over time.
2. Eligibility & account
You must have an active Shopify store and authority to install apps on it. You are responsible for the configurations you create and for the content (including images) you and your shoppers upload.
3. Subscriptions, trial & billing
- Paid plans are billed monthly through Shopify Billing. We do not process or store your card details.
- Each plan includes a 7-day free trial. If you cancel before the trial ends, you are not charged.
- You can cancel anytime by uninstalling the app or changing your plan in Shopify. Fees already billed are non-refundable except where required by law.
- Prices are as shown in the app and on our site and may change with notice for future billing periods.
4. Acceptable use & prohibited content
You agree to use the service only for lawful purposes. The following are strictly prohibited:
- Uploading, configuring, or selling through the service any content that is unlawful, fraudulent, deceptive, defamatory, hateful, or otherwise prohibited by applicable law.
- Uploading or using any image, logo, design, trademark, or other material protected by copyright or other intellectual property rights without holding the rights or a valid license to use it. This applies to content you upload and to content your shoppers upload through your store.
- Attempting to bypass, probe, or defeat security measures, billing, price signing, or rate limits.
- Copying, reverse-engineering, scraping, or extracting the app's code, design, or data, or reselling or sublicensing the service without our written authorization.
- Using the service in any way that damages, overloads, or impairs it, or that interferes with other merchants' use of it.
Misuse and enforcement. If we determine, at our sole discretion, that your use of the service violates these terms or applicable law, we reserve the right to revoke your access and terminate your subscription immediately, without notice and without refund, in addition to any other remedies available to us. We may also report unlawful activity to the relevant authorities where required.
5. Intellectual property
Our property. The Varianton app, including its software, source code, design, user interface, documentation, and all improvements to them, is and remains our exclusive property, protected by copyright and other intellectual property laws. The Varianton name and logo are our marks and may not be used without our prior written consent. These terms grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your own store while your subscription is active. No other rights are granted, whether by implication or otherwise.
Your content. You retain ownership of your store content, product data, and uploaded images. You grant us the limited rights needed to host, process, and display that content in order to provide the service. You represent and warrant that you own or hold valid licenses for all content you upload, and that nothing you configure in the service infringes the rights of any third party.
Infringement notices. If you believe content served through the service infringes your rights, contact us at info@varianton.com and we will review and, where appropriate, remove it.
6. Checkout pricing
Varianton computes and cryptographically signs configured prices, and applies them at checkout via a Shopify Function. While we take care to price accurately, you are responsible for verifying your configured prices and remain responsible for fulfilling orders and honoring your store's own terms.
7. Availability & disclaimers
The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not guarantee uninterrupted or error-free operation, and we are not responsible for downtime of Shopify or third-party providers.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits or sales. Our total liability for any claim is limited to the amount you paid us for the app in the 3 months before the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Varianton and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Content you or your shoppers upload, configure, or sell through the service, including any claim that such content infringes copyright, trademark, or other intellectual property rights of a third party.
- Any unlawful practice conducted through your store or your use of the service in violation of applicable law.
- Your breach of these terms, or your violation of the rights of any third party.
- The products you sell, your fulfillment of orders, and your own store policies.
We reserve the right, at your expense, to assume the exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.
10. Termination
You may stop using the app at any time by uninstalling it. We may suspend or terminate access for breach of these terms, misuse of the service as described in section 4, or where required by law. On termination, your data is deleted as described in our Privacy Policy. Sections 5, 8, 9, and 11 survive termination.
11. Governing law
These terms are governed by the laws of Cyprus, without regard to conflict-of-law rules.
